Educalia has been created as a virtual community. It allows different levels of consultations. It has different contents available that are freely and universally accessible and other contents that are reserved for the registered users of the community (Virtual Community and Projects).
The educational centres and offices of "la Caixa" have the tools available to register users.
Educalia offers materials and instruments that facilitate access to the information and foster exchange and interaction between the components of the educational community.
The services offered by Educalia are free. Special conditions of access or participation may be established for some specific activities. These conditions will be made known in an opportune way, and are included in these conditions just by their being referred to.
It will be necessary, in many cases, to gain access to or participate in some of the areas of Educalia, to facilitate certain personal information that shall be treated in an automated way. The files obtained will be registered and filed with the Data Protection Agency.
In fulfilment of that laid out in the Organic law 15/1999, of 13 December on the Protection of Personal Information, the user of Educalia may, at any time, exercise the different rights recognised by law: gaining of access to, rectification of, cancellation of, or opposition to the ceding of their personal information contained in the file registered with the Data Protection Agency, by sending an Email to: administrador@educalia.org.
Members of the virtual community can cancel membership at any time using the appropriate button in the Tools section of Educalia, or by contacting the school or community administrator.
Members of Educalia Projects can cancel membership at any time within the project area itself (by clicking on the appropriate button in the Users section) or by contacting the person in charge of the project.
When filling out of a form in which data concerning personal information is requested, the user will be informed of: who will receive the information, of the purpose for collecting such data, of the identity and address of the person in-charge of the file and of the authority of the user to exercise their right to gain access to, rectification of, cancellation of and opposition to how their information is treated. The personal data collected will only be treated and/or ceded for the expressed purpose and only as long as the user or client gives their consent. Once the participatory activities have finished, the data will be eliminated.
The user is under obligation to facilitate truthful, accurate and complete data about their identity when filling out the forms provided for that purpose; in the same manner, they must keep the information up-to-date. If the user facilitates inaccurate or false information, Educalia may deny them use of, or entrance to, the Virtual Community area or Project Area.
Educalia and its assignees have taken all legally required measures for the protection of personal information. They have also adopted all of the technical measures within their power to prevent the loss of, improper use of, alteration of, gaining of access to or stealing of the personal information supplied to the community. In spite of this, the user should bear in mind that security measures on the Internet are not completely inviolable. For this reason, we suggest that you consult the section on security recommendations.
Educalia uses cookies when a user surfs the web. Cookies are small files of information that an Internet server processes to the surfer and that are returned to them later, each time they connect. These files are stored in the users computer and allow the system to record the language that was chosen in former sessions. The cookies that Educalia uses are not invasive or harmful, and they do not contain any personal type of data. Nevertheless, if you so desire, you may de-activate them by following the instructions of the browser. You may also permanently eliminate those that are currently stored in your computer by accessing the pertinent directory and definitively eliminating them.
The user acknowledges that the contents presented at Educalia are protected by laws covering intellectual property and copyright laws as well as other possible types of protection. Unless indicated otherwise, the intellectual property rights of the contents pertain solely to the "la Caixa" foundation. The user acknowledges that the use of the contents remains strictly limited to their personal purposes and that the unauthorised reproduction, distribution, broadcast or transformation of these works constitutes an infraction of the intellectual property rights.
In addition to the absolute respect for the intellectual property rights -or of any other kind related to the contents, the possible identification mechanisms, or protection of them, must also be respected. The "la Caixa" foundation shall not, in any case whatsoever, be responsible for the infractions of these rights committed by users.
Unless there is a different private agreement, the rights to the pictures and to the reproduction, distribution, broadcast or adaptation of the contributions (texts, photographs, drawings, etc.) that the user of the community makes to Educalia are implied to be automatically ceded on a worldwide basis and for an indefinite period of time. This ceding shall permit the use of the material within the community (to carry out the purposes for which they were collected) as well as the authorisation for incorporating said contents in those files (CD-ROM, DVD, paper or others) that permit promotional, archival or research of Educalia by the "la Caixa" foundation.
The purpose of the links provided on the Educalia Web page is to provide different sources to expand on the information presented. The "la Caixa" foundation does not accept any responsibility related to the information on, or operating of, the webs or areas found outside of the Educalia web or that are not directly run by it.
The computer resources that Educalia makes available to the user are exclusively for recreational and educational purposes. They may not be used, under any circumstances, by users for commercial, publicity or propagandist purposes.
Any type of use, including all types of reproduction, distribution, cession to third parties, public broadcast and transformation by any type of medium or means, or of the creations or logos of the works previously referred to, is prohibited without prior, express authorisation by the respective owners. The non-fulfilment of this prohibition may constitute an infraction punishable by the legislation in-force.
The user agrees not to become involved in these unauthorised activities. Gaining access to the computerised systems as well as the alteration or manipulation of the contents, whether these systems belong to Educalia or to a third party, is expressly prohibited. Likewise, each user shall abstain from interfering or trying to interfere in the information belonging to another person; from introducing viruses, programmes, macros, "applets" or other such objects that cause or may possibly cause harm to or alterations of any type, either to Educalia or to third parties.
The "la Caixa" Foundation does not guarantee continued access to, the correct visualisation of, download or utility of the elements and information contained on the Educalia pages, that may be impeded, obstructed or interrupted by factors or circumstances beyond its control.
The "la Caixa" Foundation is not responsible for the information or other contents placed in areas of third party webs from which access has been gained by links or hyperlinks to Educalia, nor for the information and contents of any third party Web page that may be presented under the appearance or logos of Educalia, unless expressly authorised by the latter.
The responsibility for the truthfulness of the contents, information, statements, quality of service or contents offered correspond to each specific person or organisation under whose responsibility the insertion is made. The "la Caixa" Foundation shall not be responsible, in any case whatsoever, for the information created, inserted or contributed by sources not under its control.
Educalia has made an Email address (educalia@educalia.org) available to the members of the Virtual Community and Educalia Projects so that any person affected by the activity of other users may give information as to the origin of the acts and information that they consider to be illicit or that comes against their rights or those of a third party.
Likewise, the "la Caixa" Foundation assumes no responsibility for damages, losses, reclamations or expenses produced by: (i) interferences, interruptions, errors, omissions, telephonic breakdowns, delays, blockages or disconnections in the operation of the electronic system due to deficiencies, overloads and errors of the lines or telecommunication networks, or for any other reason beyond the control of The "la Caixa" Foundation; (ii) illegitimate intromissions by harmful programmes of any type and by any communication medium, either computer viruses or any other; (iii) improper or unsuitable use of Educalias WebPages; (v) security errors or of surfing produced by an incorrect functioning of the browser or by the use of versions of it that are not updated. Educalias administrators reserve the right to remove, either totally or partially, any contents or information on the Web page.
Educalia does not accept any responsibility for damages derived from an incorrect identification, lack of veracity, falsity of identifying information, or of the supplanting of any members registered by schools or centres belonging to the community, and the supplanting of any members registered by Educalia projects tutors or schools or centres ascribed to the Virtual Community.
Educalia restricts the use of some of the contents and tools available to registered users. The Virtual Community area and Educalia Projects has been created for them. The fact of being a member of the Virtual Community or participate in Educalia Projects implies the acceptance of the following conditions for use:
The user agrees to use the web as well as the contents and services offered and to comply with what is set forth in these general conditions. Likewise, they shall act according to the law, morality and good manners, and with respect for public order and the intrinsic purposes of this web. The Educalia administrator reserves the right to eliminate, either totally or partially, the contents placed on the web should these conditions not be respected.
A password is needed to gain access to Educalias Virtual Community, Educalia Projects and Email post-box. The user is solely responsible for maintaining the confidentiality of their password. They, and only they, shall be responsible for the contents and activities carried out in their commitment to maintain the secrecy of their password, care in the way they leave the community after each session, etc.
The user shall abstain from reading, eliminating, copying or modifying the email messages of other users as well as divulging them without the receivers authorisation. They shall not copy any information belonging to another user or use confidential information from the private post-box e.g., to make them public without the consent of the sender.
Educalia reserves the right to take away the entrance to or deny access to the Virtual Community and Educalia Projects at any time and without prior warning; by their own volition or by request of a third party to those users which do not fulfil the general or special conditions for use of the area.
Educalias services are of an indefinite duration. In spite of this, the "la Caixa" Foundation may, at any time and without prior warning, consider the service as having finished or unilaterally interrupt some or all of the services of Educalia.
The "la Caixa" Foundation reserves the right to unilaterally modify, at any time and without prior warning, the configuration of the virtual area of the web, the services, the contents, the conditions of gaining access to as well as the other aspects included in this document.
